Terms & Conditions

A. Definition

1. PT BUYAMIA VENTURES INDONESIA is a limited liability company that operates a web portal service business activity www.buyamia.com, which is a site for finding goods sold by registered sellers. Hereinafter referred to as Buyamia.

2. The Buyamia website is www.buyamia.com.

3. Terms & Conditions are agreements between Users and Buyamia which contain a set of rules that regulate the rights, obligations and responsibilities of users and Buyamia, as well as procedures for using the Buyamia service system.

4. Users are parties who use Buyamia services, including but not limited to buyers, sellers or other parties who just visit the Buyamia Site.

5. A Buyer is a registered User who makes a request for Goods sold by the Seller on the Buyamia Site.

6. A Seller is a registered User who opens a store and upload products to offer to Buyamia Site Users.

7. Goods are objects that are tangible / have a physical existence that can be delivered / meet the delivery criteria by the goods delivery service company.

8. Income Balance is a temporary storage facility for Seller's funds (not a fund storage facility), provided by Buyamia to accommodate funds from the sale of Goods, investment products, and/or affiliate commissions on the Buyamia Site. These funds can only be withdrawn to a registered bank account and cannot be reused to make purchases on the Buyamia Site.

B. Account, Income Balance, Password and Security

1. The user hereby declares that he is a person who is capable and able to bind himself in a legal agreement according to the law.

2. Buyamia does not charge a registration fee to Users.

3. The User understands that 1 (one) phone number can only be used to register 1 (one) Buyamia User account, except for Users who already have multiple accounts with 1 (one) previous phone number.

4. The Users who have registered have the right to act as:

   1. Buyers
   2. Sellers

5. Users who will act as Sellers are required to register as such and upload their products under their brand.

6. Users who have opened their accounts as Sellers are expected to upload product content to be traded within 14 (fourteen) calendar days after their account is successfully opened. If within 14 (fourteen) calendar days the User has not uploaded product content, then the User agrees and understands that Buyamia has the right to moderate and/or close the seller account without prior notice.

7. Buyamia, without prior notification to the User, has the authority to take necessary actions for any alleged violation or violation of these Terms & conditions and/or applicable laws, namely actions in the form of deactivation or deletion of the Goods and User account suspension or closure.

8. Buyamia has the authority to close stores or User accounts either temporarily or permanently if fraudulent transactions are found violating of the Buyamia Terms and Conditions. The user agrees that Buyamia has the right to take other necessary actions in this regard, including but not limited to refusing the application for a new account opening if similar data is found.

9. The User understands and agrees not to use, modify, disassemble, duplicate, resell and/or other exploiting activities on the software system or hardware, network and/or Site/Application data with automatic or manual technology without permission. from Buyamia.

10. The user agrees not to use and/or access the Buyamia system directly or indirectly either in whole or in part with viruses, software, or other technology that can result in weakening, damaging, disrupting or inhibiting, limiting and/or taking over functionality and integrity of the software or hardware system, network, and/or data on the Buyamia Site/Application.

11. Users are prohibited from creating and/or using hardware/software/features and/or other tools, including but not limited to emulators, robots, macros, crawlers and/or automated devices aimed at accessing or using services on the Buyamia system, such as but not limited to: (i) store data manipulation; (ii) create multiple accounts; (iii) manipulating devices that aim to harm Buyamia; (iv) crawling/scraping or content copying activities; (v) automation activities in transactions, buying and selling, promotions, and so on; (vi) addition of products to storefronts; (vii) collect (harvest) or steal user data; (viii) spamming, sending large amounts of electronic communications, sending chain letters; and/or (ix) other activities that can reasonably be assessed as acts of manipulating services and systems.

12. Buyamia has the authority to adjust the number of store transactions and the reviews and/or carry out the moderation process/closing the User's account, if it is known or suspected of fraud by the User at manipulating User transaction data in order to improve the store's reputation (review and or amount transaction). An example is doing the shopping process to the store itself using a personal account or other personal accounts.

13. Income balance only comes from the sale of goods on the Buyamia Site and cannot be added independently (top up).

14. Income balance can only be withdrawn to a bank account registered in the User's account and cannot be used as a payment method for purchases of goods.

15. Buyamia has the authority to freeze the User Income Balance if it is found/suspected of fraud in transactions and/or violation of Buyamia's terms and conditions.

16. 16. Sellers are prohibited from duplicating stores, duplicating products, or other actions that may be indicated as unfair competition.

17. The user has the right to change the store name in accordance with the policies determined by Buyamia. The User must ensure that changes to the store name are as desired, and the User is personally responsible for changes to the store name made by the User. The User agrees that any engagements and legal actions that occurred prior to the change of the store name remain binding on the User.

18. Users have the right to make changes to the account name as much as they need and Buyamia has the right to change the maximum number of times they change the account name. The User must ensure that the changes to the account name are in accordance with their desire and they are personally responsible for changes to the account name made by the User. The User agrees that any engagements that occurred prior to the name change remain binding on the User.

19. The User is personally responsible for maintaining the confidentiality of the account and password for all activities that occur in the User's account.

20. Buyamia will not ask for a username, password or verification SMS code or OTP code belonging to the User's account for any reason, therefore Buyamia urges Users not to provide such data or other important data to parties on behalf of Buyamia or other parties that cannot be guaranteed. its safety.

21. The User agrees to ensure that the User logs out of the account at the end of each session and notifies Buyamia of any unauthorized use of the User's password or account.

22. The user hereby declares that Buyamia is not responsible for any losses or obstacles that arise from misuse of User accounts caused by User negligence, including but not limited to agreeing and/or providing account login access sent by Buyamia via notification messages to other parties. through a User's device, lending an account to another party, accessing a link or links provided by another party, providing or showing a verification code (OTP), password or email to other parties, or the negligence of other Users which results in losses or problems in the User's account.

23. The User understands and agrees that in order to use the one-time password (OTP) security facility, the relevant telecommunications service provider may at any time charge the User with the following nominal (i) IDR 500 plus Value Added Tax (VAT) in accordance with the laws and regulations -the applicable tax laws in Indonesia for Indosat, Tri, XL, Smartfren, and Esia; (ii) Rp 200 plus VAT in accordance with the applicable tax laws and regulations by Telkomsel Indonesia.

24. Sellers are prohibited from promoting shops and/or goods directly using private messages, product discussions, product reviews which may disturb the comfort of other users.

C. Purchasing a Product

1. Buyers are required to transact through transaction procedures that have been set by Buyamia. The buyer makes a payment using the payment method previously chosen, and then Buyamia will forward the funds to the seller if the stages of the sale and purchase transaction on the Buyamia system have been completed.

2. When making a purchase of Goods, the Buyer agrees that:

   1. The buyer is responsible for reading, understanding, and agreeing to the information/description of the entire Goods (including but not limited to color, quality, function, etc.) before making an offer or commitment to purchase.
   2. The Buyer acknowledges that the actual color of the product as seen on the Buyamia Site/Application depends on the Buyer's computer monitor and mobile phone screen. Buyamia has made its best efforts to ensure that the colors in the photos displayed on the Buyamia Site/Application appear as accurate as possible but cannot guarantee that the color appearance on the Buyamia Site and application will be accurate.
   3. The User enters into a legally binding contract to purchase the Goods when the User purchases an Item.
   4. Buyamia does not transfer legal ownership of the goods from the Seller to the Buyer.

3. The Buyer understands and agrees that the availability of stock of the Goods is the responsibility of the Seller who offers the Goods. Regarding the availability of stock of goods, it can change at any time, so that when the stock of goods is empty, the seller will refuse the order, and payment for the goods in question will be returned to the buyer.

4. The Buyer fully understands and agrees that all transactions made between the Buyer and the Seller other than through the Buyamia Official Account and/or without Buyamia's knowledge (through private facilities/network, message delivery, special transaction arrangements outside the Buyamia site or other efforts) are the responsibility of Buyer's personal responsibility.

5. Buyamia has full authority to refuse payment without prior notification.

6. The Buyer agrees and understands that by using the Buyamia Site/Application when the Buyer makes a purchase transaction, Buyamia will forward the Buyer's information data to the Seller.

7. Payment by the Buyer must be made immediately (at the latest within 1x24 hours) after the Buyer checks-out. If within that time limit the payment has not been made by the Buyer, Buyamia has the authority to cancel the transaction. Users are not entitled to submit claims or demands for the cancellation of the transaction.

8. Buyers are advised to re-check the nominal amount of payment with the billing amount listed on the payment page.

9. Payment by bank transfer payment method (manual verification) is highly recommended to upload proof of payment on the Buyamia Application to simplify the verification process.

10. The Buyer understands and agrees that the problem of delays in the payment process and additional costs caused by the difference between the bank the Buyer uses, and the official Buyamia Account bank is the Buyer's personal responsibility.

11. Refunds from Buyamia to Buyers can only be made in the following certain circumstances:

    1. Excess payment from the Buyer over the price of the Goods,
    2. The problem of delivery of goods has been clearly identified from the seller which resulted in the goods order not arriving,
    3. The seller cannot accept orders due to out of stock, changes in shipping costs, or other causes,
    4. The seller has agreed to deliver the goods order, but after the specified time limit, it turns out that the seller does not send the goods until the specified time limit.

12. In the event of a refund process, the refund will refer to the provisions of section L. Credit Card.

13. Buyers are prohibited from dividing 1 (one) transaction of purchasing Goods into 2 (two) transactions or more separately to divide the payment value (split payment) with the aim of manipulating the payment method and/or obtaining extra benefits that violate the Terms and Conditions, which is carried out in any way including but not limited to contacting the Seller to make price changes and/or purchase multiple products to divide the total price of a desired product.

14. The buyer understands and agrees to release Buyamia from responsibility if there are problems with transactions using the split payment method, including but not limited to transaction problems, payment problems, delivery problems, as well as damage and/or loss of goods either partially or completely.

15. Buyamia is authorized to take the necessary actions if it is discovered that there is a purchase transaction using the split payment method, including but not limited to transaction cancellation.

16. The buyer agrees not to notify or submit proof of payment and/or payment data to parties other than Buyamia. In the event of a loss due to notification or submission of proof of payment and/or payment data by the Buyer to another party, then this will be the responsibility of the Buyer.

17. The buyer is obliged to confirm receipt of the Goods, after receiving the shipment of the purchased Goods. Buyamia provides a time limit of 1 (one) day (24 hours) after the delivery is "sent" on the Buyamia system, for Buyers to confirm receipt of the Goods. If within that time limit there is no confirmation or claim from the Buyer, then the Buyer thus agrees to confirm the receipt of the Goods automatically by the Buyamia system.

18. After confirmation of receipt of Goods or confirmation of automatic receipt of Goods, the Buyer's funds sent to the official Buyamia Account will be processed to be sent to the Seller (the transaction is considered complete).

19. The buyer understands and agrees that any claims made after confirmation / automatic confirmation of receipt of the Goods are not the responsibility of Buyamia. Losses that arise after confirmation/automatic confirmation of receipt of the Goods are the responsibility of the Buyer personally.

20. The Buyer understands and agrees that any problems with the delivery of Goods caused by late payment are the responsibility of the Buyer.

21. Buyamia has the authority to make decisions on unresolved transaction problems due to the absence of a settlement agreement, both between the Seller and the Buyer, by looking at the available evidence. Buyamia's decision is a final decision that cannot be contested and binds the Seller and Buyer to comply.

D. Selling a Product

1. The seller is prohibited from manipulating the price of the Goods for any purpose.

2. Sellers are prohibited from offering/trading prohibited goods in accordance with those stipulated in the provisions of point J. Types of Goods.

3. The seller is obliged to provide complete and clear photos and product information in accordance with the conditions and quality of the products he sells. If there is a discrepancy between the photo and product information uploaded by the Seller and the product received by the Buyer, then Buyamia has the right to cancel/withhold transaction funds.

4. In using the “Product Title”, “Product Photo” and “Product Description”, the Seller is prohibited from making regulations that are standard clauses that do not comply with the prevailing laws and regulations in Indonesia, including but not limited to (i ) does not accept complaints, (ii) does not accept returns (exchange of goods), (iii) does not accept refunds (refunds), (iv) goods are not guaranteed, (v) transfer of responsibility (including but not limited to covering shipping costs), (vi) depreciation of the value of the price and (vii) the unilateral delivery of random goods. If there is a conflict between store records and/or product descriptions with the Buyamia Terms & Conditions, the applicable rules are the Buyamia Terms & Conditions.

5. The seller is obliged to provide a reply to accept or reject the Buyer's Goods order within 2 days from the notification of the Goods order from Buyamia. If within that time limit there is no reply from the seller, the order will automatically be cancelled.

6. In order to maintain the convenience of the Buyer in transactions, the Seller understands and agrees that Buyamia has the right to moderate the Seller's store if the Seller rejects, cancels and/or does not respond to the Buyer's Goods order with suspicion of manipulating transactions, violating the Terms and Conditions, and/or fraud or other abuse.

7. The seller is prohibited from providing a separate payment method (split payment) and/or dividing 1 (one) Goods purchase transaction into 2 (two) different transactions with the aim of manipulating the payment method and/or obtaining additional benefits that violate the Terms and Conditions, which is done in any way including but not limited to using a "product variant" service or selling multiple products thereby dividing the total price or transaction of a desired product.

8. The seller understands and agrees to release Buyamia from responsibility if there are problems with transactions using the split payment method, including but not limited to transaction problems, payment problems, delivery problems, as well as product damage and/or loss, either partially or completely.

9. Buyamia is authorized to take necessary actions if it is known that there are sales transactions using the split payment method, including but not limited to transaction cancellations, store reviews adjustments, product deletions, store moderation, and/or store closures.

10. The Seller agrees and understands that by receiving the Buyer's information data contained in the Site/Application, he is obliged to maintain confidentiality and is prohibited from abusing the Buyer's information data in any form. Buyamia has the right, without prior notice, to investigate and impose sanctions on allegations or reports of misuse of Buyer data.

11. Sellers are expected to enter a valid delivery receipt number, namely:

    1. The date on the Goods delivery receipt cannot be earlier than the date of the Goods purchase transaction.
    2. Goods delivery receipt number must be traceable or found on the tracking website or Buyamia partner shipping service system; and/or there is a receipt for delivery of the goods that are intended for buyers who will receive the package (delivery details must be the same).

12. The seller is required to enter a valid Goods delivery receipt number within 2 x 24 hours (excluding Saturday/Sunday/National holidays) as of the notification of the Goods order from Buyamia.

13. If the Seller enters an invalid or untraceable Goods delivery receipt number, the Seller must enter a valid Goods delivery receipt number within 1 x 24 hours (excluding Saturday/Sunday/National holidays) as of the notification of the invalid receipt number or untracked provided by Buyamia to the Seller.

14. If within the time limit in the Terms & Conditions Points D. 11 and D. 12, the Seller does not enter a valid delivery receipt number, the order will automatically be considered canceled. If the Seller continues to send the Goods after exceeding the delivery time limit as described above, then the Seller understands that the transaction will still be canceled for later the Seller can withdraw the Goods at the courier where the Goods were sent.

15. The Seller understands and agrees that the delivery courier cannot be changed by the Seller after the Seller confirms the delivery and is entirely the responsibility of the Seller.

16. Buyamia is authorized to cancel transactions and/or withhold transaction funds in the event that: (i) the courier receipt number for the delivery of Goods provided by the Seller does not match and/or is suspected to be inconsistent with the transactions that occurred on the Buyamia Site; (ii) the Seller sends the Goods via courier/logistics services other than those provided and connected to the Buyamia Site; (iii) if the product name and product description do not match/unclear with the product sent; (iv) if transaction manipulation is found; and/or (v) include the delivery receipt number of the Goods that has been used by other Sellers (internal dropshipper)

17. Seller understands and agrees that all Taxes in connection with Sales transactions (but not limited to changes in store information and/or goods), will be reported and managed by each Seller in accordance with the applicable tax provisions in the laws and regulations in Indonesia.

18. Buyamia has the authority to make decisions on unresolved transaction problems due to the absence of a settlement agreement, both between the Seller and the Buyer, by looking at the available evidence. Buyamia's decision is a final decision that cannot be contested and binds the Seller and Buyer to comply.

19. If agreed by the Seller and the Buyer, the use of Logistics services that are different from the buyer's initial choice can be made (provided that the shipping rate is below the initial shipping rate).

20. Buyamia has the authority to deduct the excess shipping rate from the buyer's payment fund and return the excess shipping rate difference to the buyer.

21. The Seller fully understands and agrees that the invoice issued is in the name of the Seller.

E. Seller’s Inventory

1. Sellers are prohibited from using their shops (including but not limited to store information and item information) as a medium to advertise or promote to other web pages outside the Buyamia site.

2. Sellers are prohibited from providing personal contact data with the intention of conducting transactions directly to Buyers / potential Buyers.

3. Sellers are prohibited from providing information (information on the store and/or goods) other than/outside the description of the store and/or the goods in question.

4. The naming of the Goods and the products information must be done in accordance with detailed information, specifications and conditions of the Goods, thus Users are not allowed to include names, descriptions, pictures and/or words that are not related and/or do not match the Goods.

5. Sellers who add video references to their products or their accounts, sourced from third party links including but not limited to Youtube must comply with third party policies, in terms of Youtube policies can be seen HERE.

6. Buyamia has the right without prior notification to decrease content and/or store moderation if violations are found as stipulated in Points E.4 and E.5.

7. The seller is obliged to separate each item that has a different price.

8. Buyamia has the authority to take over the Seller's store sub-domain if the Seller's account has been inactive for more than 3 months, and/or the owner of the official trademark (in accordance with the General Register of Marks in Indonesia) with the same name as the Seller's sub-domain does claim against it because they want to use the sub-domain.

9. Buyamia has the authority to change the name and/or use the name of the Store and/or User's domain for Buyamia's internal interests.

F. Commission

1. Buyamia earns a commission from the seller of 10% on every order. The commission is included in the price displayed on Buyamia.com.

2. If in the future, our commission system or fee changes, it will be applied in transactions through the Buyamia Site and it will be notified to the affected User through the Buyamia Site.

G. Pricing

1. The price of the goods contained on the Buyamia site is the price set by the Seller. Sellers are prohibited from manipulating the price of goods in any way.

2. Sellers are prohibited from setting unreasonable prices on Goods offered through the Buyamia Site. Buyamia has the right to act in the form of decreasing content as well as other actions based on Buyamia's own judgment on the basis of unfair pricing.

3. The Buyer understands and agrees that the error in the price statement and other information caused by not updating the Buyamia website page due to the browser/ISP used by the Buyer is the responsibility of the Buyer.

4. The seller understands and agrees that typographical errors that cause the price description or other information to be incorrect/appropriate are the responsibility of the seller. Keep in mind that in this case, if there is an accidental typing error in the price description of the Goods, the Seller has the right to refuse the order of the Goods made by the buyer.

5. The user understands and agrees that any problems and/or disputes that occur due to disagreements between the Seller and the Buyer regarding the price are not the responsibility of Buyamia.

6. By placing an order through Buyamia, the User agrees to pay the total fee as stated on the payment page, which consists of the price of goods, shipping costs, and other costs that may arise and will be described explicitly on the payment page. The User agrees to make payment through the payment method previously selected by the User.

7. The maximum unit price limit for goods that can be offered is Rp. 100,000,000, -

8. The Buyamia site currently only serves goods buying and selling transactions in Rupiah currency.

H. Content

1. In using any features and/or services of Buyamia, Users are prohibited from uploading or using words, comments, pictures, videos or any content that contains elements of SARA, discrimination, demeaning or bullying others, vulgar, threatening, advertising or promoting. to sites other than the Buyamia Site, or other things that can be considered inconsistent with social values and norms or based on policies determined by Buyamia itself. Buyamia has the right to take necessary actions for violations of these provisions, including content deletion, store moderation, account blocking, and others.

2. Users are prohibited from using photos/images of goods that have a watermark indicating the ownership rights of others.

3. User hereby understand and agree that the misuse of the photos/images uploaded by the Users is the Users’ personal responsibility.

4. Sellers are not allowed to use photos/images of goods or store logos as media to advertise or promote to other sites outside the Buyamia Site or provide personal contact data to make transactions directly to buyers/potential buyers.

5. Sellers guarantee that the uploaded photos/images do not include content that is prohibited under Point I.1 or violates the property rights of other parties. If it is found that photos/images violate the content based on Point I.1 or there are reports of violations of the rights of other parties, then Buyamia has the right to take necessary actions for violations of these provisions, including but not limited to deleting content and/or other actions that need to be taken.

6. When Users upload content to the Buyamia Site, Users grant Buyamia a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensed (through multiple tiers) right to exercise any and all copyright, publicity, trademark, database rights and intellectual property rights that Users have in the content, in any known media now or in the future. Furthermore, to be fully permitted by applicable law, you waive your moral rights and promise not to claim those rights against Buyamia.

7. Users guarantee that they do not violate intellectual property rights in uploading Users’ content to the Buyamia site. Each User hereby is personally responsible for the violation of intellectual property rights in uploading content on the Buyamia Site.

8. Buyamia provides a feature to make it easier for buyers to interact with sellers regarding the goods offered. The seller is not allowed to use these features for the purpose of increasing the price of his merchandise in any way, including making comments for the first time or making subsequent / continuous comments on a regular basis (flooding / spam).

9. Although we try to offer reliable information, we cannot promise that the catalog will always be accurate and up-to-date, and Users agree that they will not hold Buyamia responsible for any discrepancies in the catalog. The catalog may include copyright, trademark or other proprietary rights.

10. Content or material that will be displayed or displayed on the Buyamia Site/Application will be subject to the Site Terms, legal regulations, and applicable advertising ethics.

11. Buyamia has the right to, at any time, take down content or material which is considered to violate the Site Terms and Conditions, applicable legal regulations, and applicable advertising ethics.

I. Types of Goods

The following is a list of the types of Goods that are prohibited and/or restricted to be traded by the Seller on the Buyamia Site:

1. All types of drugs or other substances which are prohibited or restricted in circulation according to the applicable legal provisions, including but not limited to the provisions of the Narcotics Law, Psychotropic Law, and Health Law. Also included in this provision are hard drugs, drugs that require a doctor's prescription, anesthetics and the like, or drugs that do not have a distribution permit from the Food and Drug Supervisory Agency (BPOM).

2. Cosmetics and food and beverages that endanger the safety of their users, or do not have a distribution permit from the Food and Drug Supervisory Agency (BPOM).

3. Materials classNameNameified as Hazardous Materials according to the applicable Regulation of the Minister of Trade.

6. Other goods whose ownership or circulation violates the legal provisions in force in Indonesia.

7. Goods that are the result of Copyright infringement, including but not limited to media in the form of books, CD/DVD/VCD, information and/or electronic documents, as well as other media that are contrary to the Copyright Law.

8. Adult goods of a sexual nature in the form of stimulant drugs, sex aids containing pornographic content, as well as strong drugs and adult drugs, both of which do not have a BPOM distribution permit or whose circulation is limited by applicable legal provisions.

9. E-cigarette products, e-cigarette devices, e-cigarette liquids, and/or products containing tobacco., including but not limited to tobacco cigarette products., nicotine, liquid vape, mod, pod, heat stick, vaporizer and/or E-Cigarette.

10. Alcoholic drinks.

11. Advertising.

12. Any form of writing that may negatively affect the use of this site.

13. Used underwear.

14. Firearms, sharp weapons, air rifles, and all kinds of weapons.

15. Government and travel documents.

16. Government uniform.

17. Human parts/organs.

18. Mailing lists and personal information.

19. Items that harass certain parties/races or can demean other people.

20. Pesticides, except pesticides for use which already have a registration number and permit from the Ministry of Agriculture of the Republic of Indonesia.

21. Attributes of the police force.

22. Goods resulting from theft.

23. Tools and all accessories supporting the act of robbery/theft.

24. Items that can and or are flammable, ignite or self-ignite.

25. Printed/recorded goods whose contents can disturb security & order as well as national stability.

26. Dangerous animals and/or protected animals.

27. Cash, including foreign currency, unless the Seller has and can include a license as a Non-Bank Foreign Exchange Business Operator based on Bank Indonesia Regulation No.18/20/PBI/2016 and/or other regulations related to foreign exchange.

28. Stamps

29. Signal scrambler, signal remover, and/or other tools that can interfere with the signal or telecommunications network.

30. Gambling equipment and equipment.

31. Amulets, objects that are claimed to have supernatural powers and give supernatural powers.

32. Goods with Exclusive Distribution rights that can only be traded with a direct sales system by authorized sellers and/or Goods with a Multi-Level Marketing sales system.

33. Non-physical products that cannot be sent via courier services, including but not limited to credit/voucher products (telephone, electricity, games, and/or digital credit), airplane tickets and/or train tickets.

34. Show tickets, including but not limited to concert tickets, both physical and non-physical.

35. Official documents such as TOEFL Certificates, Diplomas, Doctor's Letters, Receipts, and so on.

36. All other types of Goods that are contrary to the regulations for shipping Indonesian Goods.

37. Other goods that violate the legal provisions in force in Indonesia.

38. All types of services such as printing services, cleaning services, wedding and parenting services.

39. All types of Goods whose contents are uncertain, random and/or raffled, including but not limited to Mystery Box Products.

40. Medical devices that must have a distribution permit from the Ministry of Health or may not be traded freely.

J. Credit Card

1. Users can choose to use a choice of payment methods using a credit card for purchasing goods and digital products through the Buyamia Site.

2. Purchases of goods using a credit card can be made for purchase transactions with a total shopping value of at least Rp. 50,000 (fifty thousand rupiah) up to a maximum of Rp 50,000,000 (fifty million rupiah) for marketplace and/or digital transactions, transactions can be made up to Rp 500,000,000,- (five hundred million rupiah) specifically for purchasing car products at the Official Store .

3. Purchases of goods using a credit card must follow the terms and conditions set by Buyamia and use the courier/logistics provided and connected to the Buyamia Site.

4. Users are prohibited from using credit card payment methods other than their intended use as a means of payment.

5. If there is a purchase of goods using a credit card that violates the legal provisions and/or the terms and conditions of Buyamia, then Buyamia has the authority to: hold transaction funds for as long as required by Buyamia, the Bank, or the relevant payment gateway partner to carry out the necessary investigations, at least - at least 14 (fourteen) days; cut funds by 15% (fifteen percent) of the transaction value, as well as withdraw the subsidy value in connection with the use of credit cards.

6. Buyamia is authorized to investigate Credit Card transactions by holding the payment verification process before the transaction is forwarded to the Seller until a certain time limit until confirmation from the credit card provider bank partner, or payment gateway partner and/or canceling the Credit Card transaction if there is any indication of violation of applicable legal provisions and/or Buyamia Terms and Conditions.

7. In the verification process carried out by the bank partner and/or payment gateway partner, the User will be contacted by the bank partner and/or payment gateway partner, if the User does not deny or cancel the verification, the transaction will be forwarded to the Seller and Buyamia is not responsible if there is a loss caused by the negligence of the User.

8. The user understands and agrees that he is personally responsible for maintaining the confidentiality and/or security of User's Credit Card data by maintaining the confidentiality of the Credit Card number, Credit Card CVV code, and verification SMS code or SMS code OTP (One-time Password) which has been sent by the Bank at the time of the transaction.

9. Buyamia will stop cooperation with Sellers who take actions that can harm the principal, issuer, acquirer and/or credit card holder, including processing cash withdrawal transactions.

10. If the purchase transaction is unsuccessful and/or canceled, the bill for the transaction will be canceled and the transaction funds will be returned to the buyer's credit card limit in the next billing. The provisions in this paragraph do not apply to transactions for purchasing goods using a credit card that violates legal provisions and/or the terms and conditions of Buyamia.

11. If all transactions using a credit card are cancelled, the service fee will be returned to the User's credit card limit. However, if only part of the transaction in one payment using a credit card is canceled, the service fee will not be refunded.

K. Shipping

1. Delivery of Goods in the Buyamia system must use the services of an expedition company that has received verification of the Buyamia partner chosen by the Buyer. If the Seller enters a receipt other than the receipt of Buyamia's partners (including delivery receipts from overseas couriers), Buyamia has the right to refuse the receipt, where this may result in the cancellation of an order.

2. Any provisions relating to the process of delivery of goods are the full authority of the service provider of delivery of goods.

3. The seller is obliged to fulfill the conditions set by the delivery service and is responsible for any goods sent.

4. The user understands and agrees that any problems that occur during the process of delivering the Goods by the provider of the Goods delivery service are the responsibility of the delivery service provider.

5. In the event that it is necessary to process the return of goods, Users, both Sellers and Buyers, are required to deliver goods directly to each Buyers and Sellers. Buyamia does not accept returns or delivery of goods for transactions made by Users under any circumstances.

6. In the event of problems in the delivery process in the form of lost goods, damaged goods, etc., Buyers and Sellers can report to Buyamia no later than 1x24 hours from the time of delivery for the investigation process to be carried out.

L. Returns, Refunds and Cancellations Policy

Buyamia’s Returns, Refunds and Cancellation Policy is set forth below.

1. Buyamia offers returns on qualifying orders placed with any Sellers.

   1. From the date the order is placed, Buyers have a limited amount of time to return the products for a full refund.

   2. Items not eligible for return: Buyamia cannot accept returns for any of the following:

      1. Customized products

      2. Testers or sample items

      3. Individual items from a bundled set

      4. Items that have been used or are in less than perfect condition

      5. Seasonal items

      6. Food & Beverage items

      7. Any product that has been resized, damaged or otherwise altered after delivery

      8. Other items determined by Buyamia in sole discretion.

   3. To help us process Buyers’ returns properly and prevent future charges, Buyers must adhere to our return policies as outlined below:

      1. Return products eligible for return in new and unworn condition in the original packaging with original tags for a full refund. Original shipping fees for these products are non-refundable.

      2. Eligible products must be returned using a trackable shipping method using a shipping label provided by Buyamia (if and where available).

      3. When Buyers return eligible products, they should not also include products that are ineligible for return, as they won’t receive refunds for these products, and we cannot guarantee their return shipment. In addition, some special product, order or handling fees may still apply.

2. Cancellations. Buyers may request to cancel an order within 24 hours of placing it if the order has not yet shipped or begun processing by the Sellers. If the order has already shipped, Buyers cannot cancel.

3. Damaged or Missing Items. If Buyers receive products that are damaged or the shipment includes missing items, they must report the issue within 14 days of receipt. Buyers agree that if they do not timely report the issue, the product shall be deemed delivered and satisfactory.

   1. Buyers agree to provide the requested information including accurate photographs of all damaged items.

   2. Buyers have the option of choosing to replace the goods or to cancel the order. Buyers acknowledge and agree that it is their sole responsibility to follow up with the Sellers in an attempt to resolve the dispute, which can be done through Buyamia, and they hereby release Buyamia from all liability with respect thereto.

M. Conflicts Resolution

1. Buyamia can facilitate the resolution of transaction problems between Buyers and Sellers.

2. This feature will automatically withhold funds for payment of goods to the Sellers until the problem reported is completed.

3. In using this feature, Buyers and Sellers are expected to provide evidence of buying and selling transactions in the form of photos of goods, purchase notes, delivery receipt slips and other supporting evidence that can be used as the basis for justification for each argument issued by each party.

4. Resolution of problems can be in the form of solutions produced based on a mutual agreement between the Buyer and the Seller.

5. If the Seller does not provide an answer within 2 x 24 hours since the problem was created, the problem will automatically be resolved based on the solution proposed by the Buyer.

6. If no agreement is found between the Buyer and the Seller within 2 x 24 hours, then Buyamia has the right to help resolve the problem.

7. In the event that Buyamia helps resolve the problem, then in accordance with the Terms and Conditions of Point C. 16 and Point D. 11, the Buyer and Seller agree that Buyamia is authorized to decide on the matter by looking at the available evidence and/or evidence. new evidence that must be completed by each party.

8. Buyamia is authorized to mediate and/or make decisions for resolving problems, even though one of the parties (Buyer or Seller) has not responded to the solution provided within 2 x 24 hours, in the event that: ( i) The existence of information from third parties related to the course of the transaction, namely, among others, delivery couriers who provide information regarding the current status of package delivery receipts; (ii) Evidence from Buyers and/or Sellers sent via other communication channels (Buyamia email, User Services, etc.) that needs to be forwarded to Buyamia on the basis of transparency of the problem; (iii) Reports from either party due to the negligence of the Buyer or Seller; (iv) One of the parties (Buyer or Seller) is indicated to have committed fraud; or (v) certain conditions that cause Buyamia to immediately mediate.

9. Based on Buyamia's first decision above, both the Buyer and the Seller have the right to appeal, with the condition that the party making the appeal must submit new evidence apart from the previous evidence.

10. Buyers and Sellers hereby agree that Buyamia's decision on appeal is a final decision that cannot be contested and binds Sellers and Buyers to comply.

11. Buyers and Sellers understand and agree that in resolving problems with Buyamia’s help, Buyers and Sellers are required to respond to existing obstacles to completion by complying with the conditions and time limits as determined by Buyamia in the relevant discussion.

12. Buyers and Sellers understand and agree that the shipping costs incurred during the dispute resolution process are based on evidence and/or an agreement provided by both parties. If Buyers and/or Sellers are not willing to bear the shipping costs, then Buyamia has the authority to decide to cover shipping costs based on the development of the discussion and the available evidence.

13. Buyers understand and agree that after an agreement has been made to send the Goods back to the Seller, if within a maximum of 2 x 24 hours (excluding national holidays, Saturdays and Sundays) as of the time the Seller provides the address, the Buyer has not delivered the goods, then Buyamia is authorized to make decisions based on the development of the discussion and available evidence.

14. Sellers understand and agree that the delivery of replacement Goods for the Buyer can be made a maximum of 2 (two) working days (excluding national holidays, Saturdays and Sundays) as of the delivery status from the logistics courier that the Items returned by the Buyer have been received by the Seller. If it is found that the Seller does not comply with this provision, then Buyamia has the authority to make decisions based on the development of the discussion and the available evidence.

15. Buyers and Sellers understand and agree that the time limit for providing evidence is a maximum of 2 x 24 hours from the time Buyamia requests proof to Buyers and Sellers for related transactions.

N. Other Terms

1. If the User uses the features/services available on the Buyamia Site/Application, the User hereby declares that he understands and agrees to all the terms and conditions that are specifically regulated in connection with the features/services used.

2. Everything that has not been and/or is not regulated in the special terms and conditions in the feature will fully refer to the general terms and conditions of Buyamia.

3. By agreeing to the Buyamia Terms and Conditions, the User is deemed to be subject to Buyamia's Privacy Policy.

O. Disclaimer of Warranty and Limitation of Liability

Buyamia is a web portal offering a Customer-to-Customer Marketplace model, which provides services to Users to become Sellers or Buyers on the Buyamia website. Thus, the transactions that occur are transactions between Buyamia members, so that the User understands that the proportional limitation of Buyamia's responsibility is as a web portal service provider. Buyamia always strives to keep the Buyamia Services safe, comfortable, and functioning properly, but we cannot guarantee continuous operation or access to our Services will always be perfect. Information and data on the Buyamia site may not occur in real time. The User agrees that you utilize the Buyamia Service at the User's own risk, and the Buyamia Service is provided to you on an "AS IS" and "AS AVAILABLE" basis. To the extent permitted by applicable law, Buyamia (including the Parent Company, directors, and employees) is not responsible for, and you agree not to hold Buyamia responsible, for any damage or loss (including but not limited to loss of money, reputation, profits, , or other intangible loss) resulting directly or indirectly from:

• User's use or inability to use Buyamia Services.

• Prices, Shipping or other instructions available in the Buyamia service.

• Delays or interruptions in the Buyamia Service.

• Negligence and losses incurred by each User.

• Quality of goods.

• Delivery of goods.

• Infringement of Intellectual Property Rights.

• Disputes between users.

• Defamation of other parties.

• Any misuse of goods that have been purchased by the User.

• Losses due to unauthorized payments to other parties other than to the Buyamia Official Account, in any way on behalf of Buyamia or negligence in writing accounts and/or other information and/or negligence on the part of the bank.

• Delivery for repair of goods with an official warranty from the manufacturer. Buyers can bring the Goods directly to the nearest service center with a warranty card and purchase invoice.

• Viruses or other malicious software (bots, scripts, automation, hacking tools) obtained by accessing, or connecting to Buyamia services.

• Any interruptions, bugs, errors or inaccuracies in the Buyamia Service.

• Damage to your hardware from using any Buyamia Service.

• Content, actions, or inaction from third parties, including those related to Products on the Buyamia site that are suspected to be fake.

• Enforcement actions taken with respect to User accounts.

• There are hacking actions carried out by third parties to user accounts

P. Liability Release

If you have a dispute with one or more users, you release Buyamia (including the Parent Company, Directors, and employees) from claims and demands for damages and losses (actual and implied) of every kind and nature, known and unknown, arising from or in any way related to the dispute, including but not limited to losses arising from the purchase of Goods that have been prohibited in Point J. Types of Goods. Thus, the User intentionally waives all legal protection (contained in the law or other legal regulations) which will limit the scope of this release provision.

Q. Compensation

Users release Buyamia from claims for compensation and keep Buyamia (including the Parent Company, directors, and employees) from any claims or demands, including reasonable legal fees, made by third parties that arise in the event that you violate this Agreement, use the Buyamia Services improper use and/or your violation of the law or the rights of third parties.

R. Applicable Law

This Agreement will be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of laws rules. You agree that any legal action or dispute that may arise out of, relate to, or be in any way related to the site and/or this Agreement will be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.

S. Updates

Terms & conditions may be changed and/or updated from time to time without prior notice. Buyamia recommends that you read carefully and check this Terms & Conditions page from time to time for any changes. By continuing to access and use Buyamia's services, the user is deemed to have agreed to the changes in the Terms & Conditions.
